TPL Printing Services (the “Services”) enable Toronto Public Library (“TPL”) to offer colour and black & white printing, scanning and photocopying services at TPL library branches. Customers can submit remote print jobs and manage their Printing Services Account through an online portal.
By using the Services, you agree to be bound by the TPL Printing Services Terms of Use (the “Terms”), without modifications. TPL reserves the right to revise these Terms at any time, and may revise them without notice, by posting a revised version on the tpl.ca website. Your continued use of the Services after any changes made to these Terms shall constitute your agreement with such Terms.
Please read these Terms carefully as they form a legally binding agreement between you and TPL and the Toronto Public Library Board (the “TPLB”), as the case may be. If you do not agree to all of the terms unconditionally, please do not use the Services.
Printing and Copying Payments Options
A valid TPL Library Card (the “Library Card”) or Quick Print card with sufficient funds is required for printing and photocopying. Scanning is free with valid Library Card or Quick Print Card. You can add funds to your Library Card or Quick Print card for printing and photocopying through the online portal or you can visit any branch using debit card, credit card or cash.
Using your Library Card for printing and photocopying
The terms of use for using your Library Card to print or photocopy is governed by the TPL Membership Policy, available at tpl.ca/membership.
Active Library Card holders can request a refund or transfer of the amounts that are loaded onto the Library Card at any branch. Depending on the refund amount, refunds will be provided by cash or cheque, with latter requiring additional time for processing.
Using a Quick Print card for printing and photocopying
You can purchase a Quick Print card at any branch for $1.00 incl. HST (non-refundable). Any funds added to a Quick Print card is non-transferable and non-refundable. TPL is not responsible for any funds lost due to a lost or stolen Quick Print card. Credit balances in the print & photocopy databases will be purged after two years of inactivity, in accordance with the TPL Membership Policy.
Liability
TPL and/or the TPLB, as the case may be, is not responsible for the quality of print or photocopy jobs. TPL assumes no responsibility for any direct or indirect claims, damages or costs sought by users or third parties arising from users’ access to printing and photocopying services. TPL Printing Services are provided on an “as is” and “as available” basis and may be unavailable, due to technical issues or otherwise, across all branches or some branches. TPL does not guarantee that printing or photocopying services will be available on demand and is not required or post notice of service disruptions since this may occur on short notice and due to factors outside of TPL’s control.
Security of Information
If not released or canceled, print jobs submitted to TPL’s print servers will remain available for 24 hours. After 24 hours, print jobs are erased from the system and TPL does not maintain records of the print job after this period. TPL is not responsible for the privacy or security of the information you print, scan, or photocopy using the Services. Please use appropriate care if you choose to use the Services for sensitive or confidential information.
You agree to use the Services in full compliance with these Terms and TPL Policies. You shall not use the Services, for any purpose that is unlawful, discriminatory, or prohibited by these Terms. You agree that you will not use the Services in any manner that could damage, overburden, or impair the Services or interfere with any other person's use and enjoyment thereof.
Intellectual Property
You are responsible for all your content, including any copyright or intellectual property considerations when using the Services. TPL and/or TPLB, as the case may be, is not responsible for copyright or intellectual property considerations for materials printed, copied, or scanned using the Services. You agree to not infringe upon any copyright, trade name, trademark, service mark or other intellectual property right of any person or entity, and are solely responsible for your own conduct.
Cancellation
You may cancel your Library Card or Quick Print card at any time by notifying staff. Any remaining funds on the Quick Print card are non-transferrable and non-refundable. TPL may cancel a Library Card or Quick Print card at any time, in accordance with the TPL Membership Policy.
TPL reserves the right, in its sole discretion, to refuse to accept any content provided by you to the Systems or to refuse to process or fulfill any order at any time and for any reason. TPL further reserves the right, in its sole discretion, to temporarily or permanently suspend and/or terminate its service to you and/or your account(s) at any time and for any reason, including, without limitation, your violation of the Terms, your use of the Services’ online portal and/or the TPL’s products and services for inappropriate purposes or you having engaged in undesirable activities, in each case as determined by TPL in its sole discretion. This action is entirely at TPL’s discretion and no correspondence will be entered into. You agree that TPL and/or the TPLB, as the case may be, shall have no liability of any kind to you or to any third party arising from such refusal, suspension or termination.
Indemnities
You agree to indemnify, defend and hold harmless TPL and/or the TPLB, its officers, directors, subsidiaries, affiliates, employees, and agents from and against all loss, liability, claim, demand or suit, including reasonable legal fees, resulting from or arising out of any of your acts or omissions in connection with these Terms.
Limitation of Liability
TPL and/or the TPLB, as the case may be, its officers, directors, subsidiaries, affiliates, employees, and agents, where applicable by law, shall not be liable for any damages, including direct, indirect, punitive, incidental, general, special or consequential damages, arising out of provision of the Services, including without limitation, bodily injury, emotional distress, and/or any other damages, whether based on contract, tort, strict liability or otherwise, even if advised of the possibility of any such damages. TPL and/or the TPLB, as the case may be, is not liable for any loss of data, loss of profits, loss of property, loss of earnings, loss of business opportunities, misappropriation of personal information stored on device or any other loss, however caused resulting from the use of the Services or the enforcement of these Terms.
Miscellaneous
- Entire Agreement. These Terms constitute the entire agreement between you and TPL and the TPLB, as the case may be, with respect to the subject matter hereof.
- Governing Law. These Terms shall be governed by, construed and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, excluding their rules governing conflicts of laws.
- Severability. To the extent any provision of these Terms, including without limitation any disclaimers set forth herein, are deemed to be unenforceable as a matter of law, all remaining provisions of these Terms shall remain in effect as written.
- Third party links. The Services site may provide links to third party sites or resources. You acknowledge and agree that we are not responsible for the availability of such sites and/or resources and are not responsible or liable for any content, advertising, products or other materials on or available from such sites or resources. Such third parties have their own terms of use and other applicable policies. You should check such terms and policies before you utilize such third party sites and/or resources.
- If you use the Services on behalf of any business, organization or other entity of any kind, you represent and warrant that you are authorized to accept these Terms on its behalf and to bind such business, organization or entity to these Terms.
- You will at all times be responsible for each and every use of the Services Account. You agree to protect your log-in credentials such as your password and control any access to your account, especially when you have granted another person in your business or household access rights to your account or otherwise permit them to use your account with the purpose to use the services on your behalf. You agree that you will be responsible for all services used or other actions that are taken through your Services Account.
Privacy Notice and Authorization for Information Sharing
TPL may create, collect, use, and disclose personal information in the course of administering and operating TPL Printing Services, Printing Services Accounts, and this Terms of Use.
This personal information is collected under the legal authority of the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and the Public Libraries Act, sections 20(a) and 20(d) for TPL to administer the Services to customers who voluntarily use this service. Personal information will be handled and protected according to the TPL Access to Information & Protection of Privacy Policy.
